Emerson Archetype respects the privacy of its customers and visitors.

This Privacy Policy explains how Emerson Archetype collects, uses, discloses, and protects personal information when you visit www.emersonarchetype.com, create an account, place an order, subscribe to communications, submit a form or review, participate in a transaction, or otherwise interact with Emerson Archetype.

Emerson Archetype is operated by Lucas Emerson in Harbor City, California.

In this Privacy Policy, “Emerson Archetype,” “we,” “us,” and “our” refer to the business operated under the Emerson Archetype name.

1. Information We Collect

The information collected depends on how you interact with Emerson Archetype and the Site.

We may collect the following categories of information.

Contact Information

This may include:

  • Name;

  • Email address;

  • Mailing or shipping address;

  • Billing address;

  • Optional telephone number; and

  • Other contact information you choose to provide.

Order and Transaction Information

When you make a purchase, we may receive or maintain information such as:

  • Products purchased;

  • Order number;

  • Purchase amount;

  • Shipping information;

  • Billing information;

  • Order status;

  • Discounts or promotions used;

  • Delivery information;

  • Refund or exchange information; and

  • Communications relating to the transaction.

Payment Information

Payments made through the Site are processed using Squarespace Payments.

Emerson Archetype does not directly receive or store your complete payment card number.

Payment information is processed by Squarespace Payments and its payment, security, and fraud-prevention providers, which may include companies such as Stripe and Sift.

We may receive limited transaction information necessary to confirm and administer an order.

Customer Account Information

If you create a customer account, information associated with that account may include:

  • Name;

  • Email address;

  • Shipping or billing addresses;

  • Account preferences;

  • Order history; and

  • Other information associated with your account.

Account authentication and related credentials are processed through Squarespace's systems.

Communications and Contact Forms

If you contact Emerson Archetype directly or use a contact form, we may collect:

  • Your name;

  • Email address;

  • Message content;

  • Attachments or photographs you choose to send; and

  • Other information you voluntarily provide.

This may include information submitted in connection with customer service, service or repair requests, commissions, product inquiries, events, or other correspondence.

Commission and Custom Work Information

If you inquire about or commission custom work, you may voluntarily provide additional information such as:

  • Contact information;

  • Shipping information;

  • Knife specifications;

  • Material or finish preferences;

  • Design references;

  • Photographs;

  • Drawings; and

  • Other information relevant to the requested work.

We use this information to communicate with you and, where applicable, develop or fulfill the requested commission.

Newsletter Information

If you join the Emerson Archetype mailing list, we collect your email address through Squarespace.

Marketing subscriptions are voluntary.

Signing up for the mailing list may result in emails concerning:

  • Product releases;

  • Drops;

  • New work;

  • Events;

  • Brand updates; and

  • Other occasional marketing communications.

You may unsubscribe at any time using the unsubscribe mechanism contained in those emails.

Purchasing a product does not, by itself, mean that you have consented to receive promotional emails unless you separately opt in.

Reviews

Customers may receive automated requests from Squarespace inviting them to review products they have purchased.

If you choose to submit a review, information collected may include:

  • Your name;

  • Email address; and

  • Written review.

Information intended for publication as part of a review may appear publicly on the Site.

Review-related information may also be processed by Squarespace to operate the review feature.

Customer-Submitted Media and Testimonials

You may voluntarily send Emerson Archetype photographs, testimonials, comments, or other material.

Private emails, direct messages, photographs, or other communications are not automatically treated as authorization for public advertising or promotional use.

Where Emerson Archetype wishes to publicly use customer-submitted material that was not submitted through a feature specifically intended for publication, we may request permission separately.

2. Information Collected Automatically

When you visit the Site, certain information may be collected automatically by Squarespace and other technologies used on the Site.

This may include:

  • IP address;

  • Browser type;

  • Device type;

  • Operating system;

  • Network information;

  • Referring website or traffic source;

  • Pages visited;

  • Products viewed;

  • Searches;

  • Links or buttons clicked;

  • Scrolling or interaction data;

  • Date and time of activity;

  • Session information; and

  • General usage and performance information.

This information is used primarily to operate the Site, understand traffic and usage, maintain security, and improve the customer experience.

3. Squarespace

The Site is hosted and operated using Squarespace.

Squarespace processes information on behalf of Emerson Archetype in order to provide services including:

  • Website hosting;

  • Ecommerce functionality;

  • Customer accounts;

  • Shopping cart functionality;

  • Checkout;

  • Order management;

  • Sales tax calculation;

  • Analytics;

  • Forms;

  • Mailing lists;

  • Product reviews;

  • Email communications; and

  • Other Site functionality.

Squarespace may independently process information under its own privacy policy and contractual obligations.

4. Squarespace Analytics

Emerson Archetype uses Squarespace's built-in analytics tools.

Squarespace Analytics may collect information about visitors and Site activity, including:

  • Browser, device, and network information;

  • IP address;

  • Traffic sources;

  • Unique visitors;

  • Page views;

  • Site navigation;

  • Searches;

  • Interactions;

  • Sales and conversion activity; and

  • Cart or checkout behavior.

We use this information to understand how the Site is used, evaluate traffic, identify performance issues, and improve products, content, and Site operation.

We do not currently use Google Analytics.

5. Meta Pixel

The Site currently uses the Meta Pixel, a technology provided by Meta Platforms.

The Meta Pixel may collect and transmit information about activity on the Site to Meta.

Depending on your interaction with the Site, this may include events such as:

  • Visiting pages or product pages;

  • Searching the Site;

  • Adding products to a cart;

  • Beginning checkout;

  • Completing a purchase;

  • Joining the mailing list;

  • Creating a customer account; and

  • Other Site interactions.

The Pixel may also transmit technical information such as:

  • IP address;

  • Browser or device information;

  • Cookie or device identifiers; and

  • Information associated with the Site interaction.

Meta may use information received through the Pixel for purposes that can include advertising measurement, analytics, attribution, personalization, security, and advertising-related services in accordance with Meta's own policies and user settings.

Emerson Archetype does not currently upload customer mailing lists or intentionally synchronize customer lists to Meta for audience creation.

The Meta Pixel is separate from the Emerson Archetype product catalog provided to Meta Commerce Manager for Facebook and Instagram product functionality.

6. Meta Commerce Manager and Product Catalog

Emerson Archetype provides product and catalog information to Meta Commerce Manager so that eligible products may appear or be tagged through services such as Instagram and Facebook.

This catalog connection primarily involves product information such as:

  • Product names;

  • Product descriptions;

  • Prices;

  • Product images;

  • Availability; and

  • Product URLs.

Emerson Archetype does not currently knowingly synchronize customer mailing lists or customer audiences through this catalog connection.

7. Cookies and Similar Technologies

The Site uses cookies and similar technologies.

Cookies are small files or pieces of information stored on or associated with a visitor's device.

Similar technologies may include pixels, local storage, tags, and related technologies.

Necessary Cookies

Certain cookies are necessary for the Site to function.

These may support features such as:

  • Customer accounts;

  • Authentication;

  • Security;

  • Shopping carts;

  • Checkout;

  • Session management; and

  • Cookie preferences.

Necessary cookies may be used regardless of optional cookie preferences where required for Site operation.

Analytics and Performance Cookies

Squarespace may use analytics and performance cookies to measure how visitors interact with the Site and to provide Site analytics.

These may be used to identify sessions, measure traffic, understand navigation, and evaluate Site performance.

Marketing and Advertising Technologies

Technologies such as the Meta Pixel may be used for measurement, analytics, and advertising-related purposes.

These technologies may allow third parties to receive information about activity on the Site.

8. Cookie Choices

The Site displays a Squarespace cookie consent banner.

Visitors are currently provided options including “Accept All” and “Manage” cookie preferences.

Where supported by the Site and applicable technologies, non-essential cookies may be restricted until the visitor provides the applicable consent or preference.

Visitors may use the Manage option to control available categories of non-essential cookies.

Changing or deleting cookies through your browser may also affect Site functionality.

Some third-party integrations or embedded services may use technologies that are not fully controlled by Squarespace's cookie management system. Those third parties may provide additional privacy or cookie controls under their own policies.

9. Do Not Track and Privacy Signals

Some browsers provide a Do Not Track (“DNT”) setting or similar privacy signals.

The Site does not currently treat a DNT signal as a separate universal opt-out mechanism beyond the privacy and cookie controls otherwise provided through the Site and browser.

Visitors should use the Site's cookie-management controls to manage available non-essential cookies.

Where applicable law requires recognition of a legally valid browser-based privacy preference or opt-out signal, Emerson Archetype intends to comply with those requirements to the extent they apply to the Site and the technologies under our control.

Third parties used on the Site may have their own policies regarding DNT, Global Privacy Control, or similar signals.

10. Cross-Site and Third-Party Tracking

Certain third parties, including providers of advertising or embedded technologies, may collect information concerning visitors' online activities over time and across different websites or services.

For example, Meta may receive information through the Meta Pixel concerning interactions with the Site and may associate that information with information obtained through other websites, applications, or Meta services, subject to Meta's policies and user settings.

Emerson Archetype does not control the independent data practices of those third parties.

11. Embedded and Third-Party Content

The Site may contain embedded content, social media features, videos, media, maps, or other content provided by third-party services.

When third-party embedded content loads, the provider may receive information such as:

  • Your IP address;

  • Browser or device information;

  • The page you are viewing;

  • Cookie or account identifiers; and

  • Information concerning your interaction with the embedded content.

Third-party content and services are governed by the privacy policies of their respective providers.

12. How We Use Personal Information

Emerson Archetype may use personal information to:

  • Operate and maintain the Site;

  • Process and fulfill orders;

  • Process payments;

  • Calculate applicable sales taxes;

  • Create and maintain customer accounts;

  • Provide customer service;

  • Respond to inquiries;

  • Process returns or exchanges;

  • Handle service and repair requests;

  • Develop and fulfill commissioned work;

  • Send transaction and account communications;

  • Send marketing communications where requested;

  • Request and display customer reviews;

  • Detect and prevent fraud;

  • Protect the Site and business;

  • Enforce applicable Terms of Service;

  • Maintain records;

  • Comply with legal and tax obligations;

  • Resolve disputes; and

  • Improve Site performance, products, and services.

13. Transactional Communications

If you place an order or create a customer account, Emerson Archetype or Squarespace may send communications necessary to administer that relationship.

These may include:

  • Order confirmations;

  • Payment confirmations;

  • Shipping notices;

  • Account notices;

  • Password or security notices;

  • Review requests;

  • Service communications;

  • Return or exchange communications; and

  • Other transaction-related messages.

These communications are separate from optional marketing emails.

14. How We Disclose Information

Emerson Archetype does not disclose personal information indiscriminately.

Information may be disclosed where reasonably necessary to operate the business and Site.

Squarespace

Information may be provided to Squarespace to operate the Site, ecommerce system, customer accounts, forms, analytics, mailing lists, reviews, taxes, and related functions.

Payment and Fraud-Prevention Providers

Payment and transaction-related information may be processed by Squarespace Payments and service providers used in connection with Squarespace Payments, which may include payment and fraud-prevention providers such as Stripe and Sift.

Shipping Providers

Information necessary to deliver an order may be provided to United States Postal Service (USPS).

This may include:

  • Name;

  • Delivery address; and

  • Information reasonably necessary for shipping and delivery.

Meta

Information may be transmitted to Meta through the Meta Pixel as described in this Privacy Policy.

Product information may separately be provided to Meta Commerce Manager for catalog and product-tagging functionality.

Third-Party Embedded Services

Information may be transmitted to providers whose media, social content, or other services are embedded into the Site.

Legal and Safety Disclosures

Information may be disclosed where reasonably necessary to:

  • Comply with applicable law;

  • Respond to valid legal process;

  • Respond to lawful requests from governmental authorities;

  • Detect or investigate fraud;

  • Prevent unlawful or abusive activity;

  • Protect the security of the Site;

  • Protect Emerson Archetype's rights or property;

  • Protect customers or others;

  • Enforce the Terms of Service; or

  • Establish, exercise, or defend legal claims.

15. Sale and Advertising-Related Disclosure of Personal Information

Emerson Archetype does not sell customer mailing lists, email addresses, order histories, or other personal information for money.

We do not operate a business model based on selling personal information.

However, the Site uses the Meta Pixel.

Some privacy laws may characterize disclosures made through advertising or tracking technologies as a “sale,” “sharing,” targeted advertising, or similar activity even where no money is paid for the information.

Accordingly, visitors should not interpret our statement that we do not sell customer data as meaning that no information is ever transmitted to an advertising technology provider.

The Meta Pixel disclosure above describes that activity.

Where applicable law provides a legal right to opt out of a particular advertising-related disclosure, Emerson Archetype will honor that right where required.

Visitors may also use the Site's cookie-management tools to control available marketing and non-essential cookie settings.

16. Marketing Communications

Emerson Archetype sends promotional emails only to people who have subscribed or otherwise lawfully consented to receive them.

You may unsubscribe from marketing communications at any time using the unsubscribe link in the message.

Unsubscribing from marketing emails does not prevent Emerson Archetype from sending necessary transactional or service communications relating to an existing order, account, service request, or other business relationship.

17. Data Retention

Emerson Archetype does not currently maintain a single fixed retention period for every category of personal information.

Information is retained for as long as reasonably necessary for purposes including:

  • Fulfilling orders;

  • Maintaining customer accounts;

  • Customer service;

  • Product service history;

  • Custom commissions;

  • Tax and accounting obligations;

  • Fraud prevention;

  • Security;

  • Recordkeeping;

  • Resolving disputes;

  • Enforcing agreements; and

  • Complying with applicable law.

Different categories of information may therefore be retained for different periods.

When information is no longer reasonably necessary, it may be deleted, anonymized, or retained where continued retention is legally or operationally justified.

18. Access, Correction, and Deletion Requests

You may contact Emerson Archetype to request access to, correction of, or deletion of personal information associated with you.

To protect customer information, Emerson Archetype may request information reasonably necessary to verify your identity before fulfilling a request.

Depending on the circumstances, verification may involve information such as:

  • Name;

  • Email address;

  • Order number; or

  • Other information associated with your relationship with Emerson Archetype.

A deletion request does not necessarily require deletion of every record.

Information may be retained where reasonably necessary or legally permitted for purposes such as:

  • Completing transactions;

  • Tax or accounting records;

  • Fraud prevention;

  • Product service records;

  • Legal compliance;

  • Security;

  • Dispute resolution; or

  • Establishing or defending legal claims.

Where applicable law grants additional rights or imposes different requirements, those requirements will control.

19. California Privacy Information

Emerson Archetype operates from California and collects personal information from California residents.

California users may contact Emerson Archetype using the information below to request review or correction of personal information maintained about them.

The categories of personal information we collect and the categories of third parties to whom that information may be disclosed are described throughout this Privacy Policy.

The Site may permit third parties, including Meta and providers of embedded services, to collect information concerning Site visitors as described above.

This Privacy Policy also explains how the Site responds to Do Not Track and similar mechanisms.

Emerson Archetype does not sell customer personal information for monetary consideration.

Not every California privacy statute applies to every business. Where California law grants a particular privacy right to a visitor or customer and applies to Emerson Archetype, Emerson Archetype will honor that right as required by law.

20. Security

Emerson Archetype uses reasonable administrative, technical, and platform-based measures intended to protect personal information.

Much of the Site's technical infrastructure, payment processing, account functionality, and ecommerce security is provided through Squarespace and its service providers.

No method of transmission over the internet and no electronic storage system can be guaranteed to be completely secure.

Accordingly, Emerson Archetype cannot guarantee absolute security of information.

21. Children

The Site's products are intended for adults, and purchases from Emerson Archetype are restricted to persons 18 years of age or older.

The Site is not directed to children under the age of 13, and Emerson Archetype does not knowingly collect personal information from children under 13.

If Emerson Archetype learns that personal information was knowingly collected from a child under 13 without appropriate authorization, reasonable steps will be taken to delete it.

22. United States Operations and International Visitors

Emerson Archetype is based in the United States.

The Site may be accessed by visitors outside the United States, but Emerson Archetype currently sells and ships products only within the United States.

Information collected through the Site may be processed or stored in the United States or in other locations where Squarespace or other service providers operate.

Visitors outside the United States should understand that privacy and data-protection laws may differ from those in their own jurisdiction.

Where applicable law imposes requirements concerning a visitor's information, Emerson Archetype will comply to the extent those laws apply.

23. Business Transfers and Reorganization

If Emerson Archetype is later incorporated, reorganized, merged, acquired, sold, or transfers all or part of its business or assets, information maintained as part of the business may be transferred to the applicable successor, purchaser, or reorganized entity.

Any such transfer will remain subject to applicable law and the privacy obligations governing the information.

24. Third-Party Privacy Practices

This Privacy Policy applies to Emerson Archetype's own handling of personal information.

It does not control how independent third parties handle information under their own policies.

Third parties may include:

  • Squarespace;

  • Payment processors;

  • Fraud-prevention providers;

  • Meta;

  • USPS;

  • Embedded media providers;

  • Social media platforms; and

  • Other external services accessed through the Site.

Visitors should review the privacy policies of third-party services where appropriate.

25. Changes to This Privacy Policy

Emerson Archetype may update this Privacy Policy from time to time to reflect:

  • Changes to the Site;

  • New services or technologies;

  • Changes in business practices;

  • Changes in service providers; or

  • Changes in applicable law.

When this Privacy Policy is updated, the Last Updated date at the top of the policy will be revised.

Material changes may also be communicated through the Site where appropriate.
